1. Introduction
These Terms & Conditions outline the arrangements for driving lessons provided by HPM Driving, an independent automatic driving school based on the Wirral.
By booking driving lessons, you agree to these terms, provided they have been made available to you before booking. Please read them carefully before your first lesson.
These terms do not affect your statutory consumer rights.

2. Driving Licence Requirements
You must hold a valid provisional or full driving licence that legally entitles you to drive the tuition vehicle.
You must meet the legal eyesight requirements and inform me of any medical condition or change in circumstances that may affect your ability to drive safely.
You are responsible for informing the DVLA of any relevant medical conditions where legally required.
I may request to see your driving licence and carry out appropriate licence checks before lessons begin.
Lessons cannot take place if you are not legally entitled to drive.

3. Lesson Bookings
All driving lessons must be arranged and confirmed directly with HPM Driving.
Standard lesson durations, prices and availability will be confirmed at the time of booking.
Lesson dates and times may occasionally need to change due to unforeseen circumstances.
Submitting an enquiry does not guarantee lesson availability or confirm a booking.

4. Lesson Payments
The price and payment arrangements for each lesson or lesson package will be confirmed before booking.
Payment must be made by the agreed deadline.
Prepaid lesson credit will be recorded against your learner account and deducted as lessons take place.
Prepaid credit does not guarantee particular lesson dates or times.
Any outstanding balance must be settled before further lessons are booked, unless otherwise agreed.

5. Learner Cancellations
A minimum of 48 hours' notice is required to cancel or rearrange a driving lesson.
If less than 48 hours' notice is given, the full lesson fee will be charged, subject to applicable consumer law and the fairness of the charge in the circumstances. Where a lesson has been prepaid, the applicable charge will be deducted from your remaining lesson credit.
If you fail to attend a booked lesson without providing notice, the full lesson fee will ordinarily be charged, subject to the same fairness requirements.
Cancellations made with at least 48 hours' notice will not incur a cancellation fee.
Exceptional circumstances, including situations where charging the full fee would be unfair, will be considered individually.

6. Instructor Cancellations
Occasionally, I may need to cancel or rearrange a lesson due to illness, vehicle problems, unsafe weather conditions or circumstances outside my control.
If I cancel a lesson, you will not be charged for the lesson that has not taken place.
Any payment already made for that lesson will be carried forward to a rearranged lesson or refunded where appropriate.
I will always aim to provide as much notice as reasonably possible.

7. Punctuality and Lesson Duration
Please be ready at the agreed collection location at the scheduled lesson time.
If you arrive late, your lesson may still finish at the originally agreed time to avoid affecting other learners.
If I am running late, I will aim to notify you as soon as possible and make up any lost teaching time or provide an appropriate adjustment.
If you are not present at the agreed collection point, I will make reasonable attempts to contact you before treating the lesson as missed.

8. Fitness to Drive
You must be fit and legally able to drive during every lesson.
You must not attend lessons under the influence of alcohol, illegal drugs or medication that impairs your ability to drive safely.
If I reasonably believe you are unfit to drive, I may refuse to begin or continue the lesson.
Any charge for a lesson that cannot proceed will be considered fairly according to the circumstances.

9. Conduct During Lessons
HPM Driving aims to provide a calm, supportive and respectful learning environment.
Learners are expected to follow reasonable safety instructions and treat the instructor and tuition vehicle with respect.
Abusive, threatening or unsafe behaviour will not be tolerated.
I reserve the right to stop a lesson where continuing would create a genuine safety concern.

10. Learning Progress
Every learner progresses at a different pace, and the number of lessons required will vary.
I will provide professional guidance, feedback and recommendations based on your individual progress.
Passing the driving test cannot be guaranteed, and purchasing lessons or lesson packages does not guarantee a particular test result.

11. Driving Tests
You are responsible for ensuring that your driving test is booked correctly and that you meet the DVSA's requirements.
Use of the HPM Driving tuition vehicle for a practical driving test must be agreed in advance and is subject to availability and my professional assessment of your readiness.
I reserve the right to decline the use of my vehicle if I reasonably believe you are not sufficiently prepared to drive safely and independently, or if the vehicle cannot legally or safely be used.
I will explain any concerns and aim to give reasonable notice wherever possible.
Any charges for test-day tuition and vehicle use will be explained before booking.
DVSA test fees are separate unless explicitly stated otherwise.
HPM Driving is not responsible for DVSA decisions, examiner assessments or test cancellations outside my control. Your statutory rights are unaffected.

12. Prepaid Lessons, Course Discounts and Refunds
Prepaid lessons and courses will be recorded as credit against your learner account.
Discounted course prices are offered on the understanding that the full course will be completed.
If a learner chooses to cancel a discounted course before completing all lessons and requests a refund, the lessons already taken will be recalculated at the standard, non-discounted lesson rate applicable when the course was purchased.
The cost of lessons already completed, together with any applicable and lawful cancellation charges, will be deducted from the original course payment. Any remaining balance will be refunded.
The recalculation will not result in the learner owing additional money solely because they have chosen to end the course early.
This adjustment will not apply where HPM Driving cancels the course, is unable to provide the agreed lessons, or where the learner is exercising statutory rights that prevent such a deduction.
Refunds will be processed within a reasonable period, subject to any applicable legal deadlines.
Nothing in these terms affects your statutory consumer rights.

13. Vehicle and Insurance
Driving lessons will take place in an appropriately insured automatic tuition vehicle.
The vehicle will be maintained to the standards required for road use.
Learners must follow reasonable instructions regarding the safe use of the vehicle.
Any accident, damage or incident during a lesson will be handled according to the circumstances and applicable insurance arrangements.
Learners will not automatically be held financially responsible for vehicle damage simply because an incident occurred.

14. Personal Information
Personal information collected during enquiries, bookings and driving lessons will be handled in accordance with the HPM Driving Privacy Policy.
Learner records may include contact details, bookings, payment information and driving progress notes.
Your personal information will not be sold to third parties.

15. Photographs and Social Media
Learners may be invited to have a photograph taken following a successful driving test.
Photographs, names and testimonials will only be shared on HPM Driving's website or social media with appropriate permission.
You are under no obligation to agree to photographs or publicity.

16. Complaints and Concerns
If you have any concerns about your lessons or the service provided, please contact me directly so I have an opportunity to address the issue.
I aim to deal with concerns fairly, professionally and as promptly as reasonably possible.
Nothing in these terms affects your legal rights as a consumer.

17. Changes to These Terms
These Terms & Conditions may be updated from time to time.
Any changes affecting existing bookings or prepaid lessons will be communicated appropriately and will not retrospectively remove agreed contractual or statutory rights.
